Find answers to common questions about our compliance services
General Questions
Any motor carrier operating interstate (crossing state lines) and transporting household goods needs to comply with FMCSA regulations. This includes arbitration program participation, maintaining a tariff, and having a BOC-3 process agent on file.
Non-compliance can result in significant fines (up to $16,000+ per violation), out-of-service orders, and potential loss of operating authority. It can also affect your ability to win contracts and maintain insurance.
Arbitration enrollment is instant - you'll have your documents within minutes. BOC-3 filing typically takes 1-2 business days. Tariff documents are completed within 3-5 business days depending on complexity.
Arbitration Program
The Arbitration Summary is a document you must provide to every customer before they sign the Bill of Lading. It explains their arbitration rights for dispute resolution. We generate this document with your company information when you enroll.
Customers must first file a claim directly with you. If unresolved, they can contact us to verify your enrollment, then file for arbitration with NAM (National Arbitration and Mediation). NAM handles the actual arbitration process and bills both parties directly for their fees.
For claims of $10,000 or less, if the customer requests binding arbitration, you must participate. For claims over $10,000, both parties must agree. FMCSA requires you to offer arbitration as an option to all customers.
Tariff Publishing
A tariff is a comprehensive document that lists all your rates, charges, rules, and service terms. FMCSA requires interstate household goods movers to maintain a current tariff and make it available to customers upon request. It protects both you and your customers by clearly defining pricing.
Yes, you can request tariff updates as your rates or services change. Minor updates may be included at no charge; significant revisions may have a small fee. Contact us to discuss your specific needs.
BOC-3 Process Agent
A BOC-3 form designates process agents who can accept legal documents on your behalf in each state where you operate. FMCSA requires this for all interstate motor carriers. Without a valid BOC-3 on file, your operating authority cannot be activated or maintained.
You can transfer to our blanket agent at any time. Simply select "Transfer" as your filing type when ordering. The new filing will replace your old one automatically with FMCSA.
